Terms of service

General Terms and Conditions

Version: October 2026

§ 1 Scope, provider, definitions

(1) These Terms and Conditions apply to all contracts for the supply of goods that a consumer or a business ("Customer") concludes with us via our online shop (one-off purchases and subscriptions).

(2) The provider and contracting party is PICKI NIKI GmbH, Torstraße 172, 10115 Berlin, Germany; represented by its managing directors Namkyoung Lee and Andreas Brepohl; registered at the Local Court of Berlin (Charlottenburg) under HRB 239267 B; VAT ID DE352553166; telephone +49 800 00 60 968 (free of charge from Germany; from abroad, please use email), email support@pickiniki.com.

(3) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed professional (Section 13 German Civil Code (BGB)). A business is a person who acts in the exercise of a commercial or self-employed professional activity when concluding the contract (Section 14 German Civil Code (BGB)).

(4) These Terms and Conditions apply exclusively. Any deviating terms of the Customer only become part of the contract if we expressly agree to them. Individual agreements take priority.

(5) The version in force at the time the contract is concluded applies. We store the contract text (order details and these Terms and Conditions in the version in force at the time of contract). We send the order details and these Terms and Conditions to the Customer by email with the order confirmation; Customers with a customer account can view their orders there. Before submitting the order, the Customer can save the contract text using the print or save function of their browser.

§ 2 Conclusion of the contract

(1) The presentation of products in the shop is not a binding offer but an invitation to place an order.

(2) The Customer collects products by clicking "Add to cart". In the cart and at checkout, the Customer sees all details in one overview before submitting. Input errors can be recognised there and corrected using the input fields, the edit functions at checkout or by returning to the cart; the Customer can cancel the process at any time by closing the browser window.

(3) By clicking the button "Pay now", the Customer makes a binding offer.

(4) We confirm receipt of the order by email without undue delay; this confirmation does not yet constitute acceptance.

(5) The contract is concluded when we accept the order by a separate email (order confirmation or shipping confirmation) or dispatch the goods. We accept or reject the order within three working days of receiving it. After that period, the Customer is no longer bound by the order.

(6) If we do not accept the order (for example because the goods are unavailable), we will inform the Customer without undue delay and refund any payments already made without undue delay. We supply goods in normal household quantities. We do not accept orders that are recognisably intended for resale unless we have agreed this with the Customer in advance.

(7) We have not submitted to any codes of conduct.

(8) The Customer provides correct details when ordering and in the customer account, in particular the delivery address and email address, and keeps the login details for the customer account confidential. If these details change during an ongoing subscription, the Customer updates them in the customer account or informs us.

§ 3 Contract languages

Contracts can be concluded in German, English, French, Italian and Spanish. The language in which the Customer placed the order is authoritative.

§ 4 Prices and shipping costs

(1) All prices are final prices and include statutory VAT where it applies. Shipping costs are added unless free shipping is stated.

(2) Shipping costs are shown separately during the ordering process before the order is submitted. Details can be found in our Shipping Terms.

(3) For deliveries to countries outside the EU that are not shipped from a warehouse in the country of destination, customs duties, import charges or import VAT may apply, which are payable by the Customer. Details can be found in our Shipping Terms.

§ 5 Payment

(1) Payment is made via the Shopify checkout. The payment methods available in each case (in particular Visa, Mastercard, American Express, PayPal, Klarna, Apple Pay, Google Pay, Shop Pay) are displayed before the order is submitted.

(2) The purchase price is due when the contract is concluded, unless otherwise specified for the payment method.

(3) Where payment service providers are used, their terms of use apply in addition. In the event of late payment, the statutory provisions apply.

§ 6 Delivery and availability

(1) We deliver to the countries named in our Shipping Terms. Deliveries to the United Kingdom are shipped from our warehouse in the United Kingdom; all other deliveries are shipped from Germany. We dispatch the goods within three working days of the conclusion of the contract. Delivery time from dispatch is up to 3 working days to Germany, up to 6 working days to other European delivery countries, up to 3 working days to the United Kingdom and up to 10 working days to other delivery countries. In any case, we deliver within 30 days after the contract is concluded, unless we agree otherwise with you.

(2) If ordered goods are unavailable, we will inform the Customer without undue delay and refund any payments already made without undue delay.

(3) For consumers, the risk passes on handover of the goods to the Customer; for businesses, on handover to the carrier.

(4) We ask that obvious transport damage be reported to support@pickiniki.com as promptly as possible, ideally with a photo. If the Customer does not do so, this has no effect on the Customer's statutory rights.

(5) As long as the goods have not yet been dispatched, the Customer can cancel the order by email to support@pickiniki.com. We will then refund all payments made in full and without undue delay. The statutory right of withdrawal is not affected.

§ 6a Undeliverable, uncollected and refused parcels

(1) If a parcel is returned to us for reasons for which the Customer is responsible, in particular because it was not collected within the carrier's holding period, because the address provided by the Customer was incorrect or incomplete, or because the Customer refused to accept it, we will inform the Customer and ask whether they would like the parcel to be sent again.

(2) For a second dispatch, we charge a flat amount for the second delivery and handling (return transport, goods receipt, inspection, restocking and re-dispatch) of €15 for deliveries within Germany, £15 for deliveries within the United Kingdom and €25 for deliveries to other countries. The Customer is entitled to prove that we have incurred no expense or a significantly lower expense. We state the flat amount in our message under paragraph 1; we only carry out the second dispatch once the Customer has expressly ordered it with reference to the flat amount.

(3) If a consumer does not wish the parcel to be sent again, we treat this as a withdrawal; we refund all payments in accordance with the withdrawal information, including the costs of standard delivery. The direct costs of the return transport that the carrier charges us for this are borne by the Customer, as with any return following a withdrawal; we offset them against the refund. In relation to businesses, we refund the purchase price less the flat amount under paragraph 2; the second sentence of paragraph 2 applies accordingly.

(4) If a consumer withdraws from the contract after having paid the flat amount for re-dispatch, we will also refund that amount.

(5) If we are responsible for the return, for example due to an address or shipping error on our part, we will re-send the parcel free of charge.

§ 7 Retention of title

The goods remain our property until payment has been made in full; in relation to businesses, until all claims arising from the business relationship have been settled.

§ 8 Subscriptions (recurring deliveries)

(1) For a subscription, we deliver on a recurring basis at the delivery interval offered in the ordering process and chosen by the Customer; subscriptions are administered via the service Skio.

(2) The subscription runs for an indefinite period with no minimum term until cancelled. Billing takes place at the start of each billing period. The price, discount and delivery interval are displayed before the order is submitted.

(3) Payment is taken automatically via the stored payment method at the start of each billing period, unless paid in advance.

(4) The Customer may cancel the subscription at any time without giving reasons. The cancellation takes effect for all deliveries that would be billed later than two working days after the cancellation is received.

(5) Cancellation can be made in particular via the always-accessible cancellation button required by German law ("Cancel contracts here") at www.pickiniki.com/pages/vertraege-hier-kuendigen, without login details; it can also be made via the customer account, the link in the order email or informally by email.

(6) We confirm receipt of a cancellation declared via the button immediately by electronic means in text form (email), stating its content, the date and time of receipt and the date on which the subscription ends.

(7) We will give notice of any changes to price or service in text form in good time. They only take effect once the Customer has expressly agreed to them. If the Customer does not agree, either party may end the subscription with effect from the next delivery date.

(8) The statutory right of withdrawal for the subscription contract is not affected. In addition, we grant a right of withdrawal for each individual subscription delivery in accordance with the withdrawal information, starting on receipt of that delivery. The statutory warranty (§ 10) and the voluntary 60-day money-back guarantee (§ 10 paragraph 3) apply to each individual subscription delivery.

(9) We may end the subscription by giving one month's notice in text form, for example if we no longer offer a product. Deliveries that the Customer has already paid for are not affected: we either deliver them or, if we can no longer deliver them, refund the amount paid without undue delay. The right of either party to terminate for good cause is not affected.

§ 9 Right of withdrawal for consumers

(1) Consumers have a statutory right of withdrawal. The full withdrawal information and the model withdrawal form are contained in our separate withdrawal information, which forms part of these Terms and Conditions.

(2) Withdrawal can be declared via our electronic withdrawal function ("Withdraw from contract here") at www.pickiniki.com/pages/vertrag-widerrufen, or by any other means by an unequivocal statement, for example by post or email.

§ 10 Statutory warranty (liability for defects) and voluntary guarantee

(1) The statutory provisions apply (German Civil Code (BGB), Sections 434 et seq., and for consumers Sections 474 et seq.). If you live in the United Kingdom, your rights under the Consumer Rights Act 2015 are not affected. If you live elsewhere, you keep the mandatory defect rights of your country. Exercising your statutory rights in respect of defects is free of charge for you.

For consumers in the European Union, the following harmonised notice on the legal guarantee of conformity applies:

Harmonised notice on the legal guarantee of conformity (Implementing Regulation (EU) 2025/1960)

(2) In relation to consumers, the statutory periods for defect claims apply, at least two years from delivery; longer mandatory periods of the consumer's country of residence remain unaffected. In relation to businesses, the limitation period for defect claims for new goods is one year from delivery. This does not apply to claims for damages under § 11 paragraph 1, to fraudulently concealed defects or to recourse claims under Sections 445a and 445b German Civil Code (BGB).

(3) A voluntary guarantee exists only where expressly declared. Independently of this, we voluntarily grant a 60-day money-back guarantee for the entire order, including subscription deliveries, under our guarantee terms (section "Guarantee terms"). The guarantee affects neither the statutory right of withdrawal nor the statutory warranty.

(4) We bear the expenses required for subsequent performance (repair or replacement), in particular transport and return shipping costs (Section 439(2) German Civil Code (BGB)). On request, we will pay an advance for these costs or provide a return label. If a consumer withdraws from the contract because of a defect (rescission), we bear the costs of returning the goods (Section 475(7) German Civil Code (BGB)).

§ 11 Liability

(1) We are liable without limitation for injury to life, body or health, for intent and gross negligence, under the German Product Liability Act (Produkthaftungsgesetz) and to the extent of any guarantee we have given.

(2) In the event of a slightly negligent breach of an essential contractual obligation, our liability is limited to the foreseeable damage typical for this type of contract. Essential contractual obligations are those whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance the Customer may rely. This does not limit your statutory rights as a consumer, in particular under the Consumer Rights Act 2015.

(3) In relation to businesses, liability for the slightly negligent breach of non-essential contractual obligations is excluded.

(4) The limitations in paragraphs 2 and 3 also apply in favour of our legal representatives and vicarious agents.

§ 12 Notes on product use

Please follow the instructions for use. Persons with allergies or sensitive skin are advised to seek medical advice before using scented filters. Statutory rights remain unaffected.

§ 13 Complaints and consumer dispute resolution

(1) Complaints can be sent to support@pickiniki.com, by telephone to +49 800 00 60 968 (free of charge from Germany; from abroad, please use email) or by post to our address.

(2) Pursuant to Section 36 German Consumer Dispute Resolution Act (VSBG): we are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board. If we reject a complaint from a consumer in the United Kingdom, we will tell them about any ADR scheme that is open to them.

§ 14 Applicable law and place of jurisdiction

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods; mandatory consumer protection provisions of the country of habitual residence remain unaffected. If you are a consumer in the United Kingdom, mandatory UK consumer law, including the Consumer Rights Act 2015, continues to apply.

(2) In relation to merchants and legal entities under public law, the place of jurisdiction is Berlin; in relation to consumers, the statutory places of jurisdiction apply. Consumers may bring proceedings in the courts of the country where they live, as far as the law allows.

§ 15 Final provisions

(1) Should individual provisions be invalid, the validity of the remaining provisions remains unaffected; the statutory provisions take the place of the invalid provisions.

(2) Each contract is governed by the version of these Terms and Conditions in force at the time the contract is concluded. Changes to these Terms and Conditions only apply to ongoing subscriptions with the Customer's express consent; § 8 paragraph 7 applies accordingly.
